ELECTRONIC STABILITY CONTROL (ESC),SERVICE BRAKES

Government / agencyIndexed Oct 9, 2026Source-linkedVerify source — NHTSA complaint #11616328

The contact owns a 2024 BMW X5. The contact received notification of NHTSA Campaign Number: 24V104000 (Electronic Stability Control (ESC), Service Brakes) however, the part to do the recall repair was unavailable. The contact stated that the manufacturer had exceeded a reasonable amount of time for the recall repair. The manufacturer was not made aware of the issue. The contact stated while driving approximately 35 MPH, a warning flashed on the instrument panel to stop the vehicle and to use the parking brake. The contact pulled over and became aware that the vehicle had independently shifted to neutral(N). The contact depressed the brake pedal and observed that "use emergency brake" message was displayed on the instrument cluster. The contact stopped and turned off and restarted the vehicle to attempt to reset the computer; however, a symbol of a vehicle was flashing RED on the instrument cluster while attempting to restart the vehicle. The vehicle failed to restart. The contact had the vehicle towed to a dealer. The vehicle was not diagnosed and was not repaired. The failure mileage was approximately 11,000. VIN tool confirms parts not available.

Government / agencyIndexed Oct 9, 2026Source-linkedVerify source — NHTSA complaint #11571458

- As we were driving down a largely empty highway ([XXX] near Pollock Pines, CA), we heard an extremely loud bang. We looked back and the large rear sunroof (the non-moving one) had exploded - the glass was crazed with shatter fragments and continued to audibly crackle for several minutes. No significant sections of the glass had fallen out, but there were small splinters of glass (< 1mm in size) all over the cabin including on our 4 month old in the rear seat. - The vehicle is currently at the dealer service center awaiting service. It is available for inspection on request. As far as I know it has only been inspected by me and the dealer service representative. - The explosive sound caused a significant distraction while driving, and the glass fragments that rained into the cabin resulted in a minor injury to my hand and posed a risk of internal and external lacerations to all of us. - At no point were there any warnings prior to the explosion. Afterwards, there were also no warnings, though the problem was obvious. There are several nearly-simultaneous reports of this on new X5s: [XXX] INFORMATION REDACTED PURSUANT TO THE FREEDOM OF INFORMATION ACT (FOIA), 5 U.S.C. 552(B)(6)

Engine failure

Government / agencyIndexed Oct 9, 2026Source-linkedVerify source — NHTSA complaint #11716116

I bought this car and started to have issues after a couple weeks. Because it is a hybrid model, it works perfectly fine when the car is running on the battery. Immediately the engine began to work, I get hesitation and the car drives rough. I took it to the first dealership that said there was water in the engine but they were proved wrong because what they show as water was apparently fuel that did not burn the right way in the cylinder. The dealership came with another excuse that the filter had traces of water which makes them to believe something was wrong. I took the car to another bmw dealership as I did not trust their diagnosis. The other bmw dealership performed some work on the car but then came to the conclusion that their hands were tied because of what the previous dealership reported to bmw north america. I called bmw north america and they told me to go back to the dealership after I had no success at the dealership. I believe this is a lemon case and also constitute a safety hazard because I nearly had an accident because the car switch from running on battery to combustion and immediately on the highway. The speed slows abruptly and car began to drive rough. I would appreciate any traction this can get from the board to resolve this with the manufacturer

My 2024 BMW X5 experienced a complete megatronics failure at 54,500 miles. The megatronics unit controls critical vehicle functions including transmission and engine management. This failure caused the vehicle to become completely inoperable — posing a significant safety risk. This failure occurred just 4,500 miles beyond the factory warranty on a barely 2 year old vehicle. A 2024 model year vehicle should not experience such a critical safety-related failure at this mileage. BMW Corporate has been unresponsive for 7 days despite opening case number XXX and promising a 3-5 business day response. I am requesting NHTSA investigate whether this is a widespread defect that may affect other 2024 BMW X5 owners. Incident Description: "Vehicle suddenly entered limp mode while driving at highway speed on XXX in [XXX] . This caused an unexpected and dangerous loss of power while surrounded by highway traffic creating a significant safety hazard. Vehicle was unable to maintain highway speeds and had to be carefully maneuvered to the shoulder of the road. Vehicle was subsequently driven to BMW Dealership in [XXX] where it was diagnosed with a complete megatronics failure." I purchased this BMW X5 xDrive50e vehicle from BMW showroom in kalamazoo, MI as a pre-owned vehicle. It looks like this particular vehicle had already reported an drivetrain issue based on the NHTSA complaint: [XXX] Looks like Drivetrain malfunction issue is a recurring one in BMW X5 50e and hit with the same issue on [XXX]. Here, i want to file a complaint regarding a safety issues with this 2024 BMW X5 xDrive50e, which currently has 14,065 miles. Vehicle started showing 2 Error messages. (1) Drivetrain Malfunctions Error stating that driving is not possible and asking to call the roadside assistance. (2) Regenerative braking of the vehicle is disturbed. It is possible to continue driving and asking to schedule a service appointment. On seeing these messages, called the BMW SoS line and informed them about the issue and towed the vehicle to the nearest service center. After running the diagnostics on the vehicle, Service center confirmed that EGS diagnostics test is inconclusive and mechatronics parts require a replacement. Service center stated that some of the parts are available within the country and few has to be shipped from Germany. Currently, vehicle is in service center waiting for the parts to get replaced. I purchased my 2024 BMW X5 new at BMW Alexandria, Virginia it’s have approximately 34,000 miles . I have taken X5 into dealer warranty repairs regarding malfunction emergency call system since May 2026. Total 3 visits to dealer to resolve this issues has been unsuccessful in resolving the issues . At the moment ,‘‘quote’’from dealership below: the shop foreman has opened the TASARA CASE on the vehicle....and has sent the information to the head engineer of BMW OF NORTH AMERICA. We are waiting on a response at to what to do with the issue that we have....it may need a new HUH module . On two additional separate visits 2 TCU or TSB modules and 1 wiring harness were replaced. On 06/30/26 dashboard warning emergency call malfunction REAPPEAR AGAIN. There are numerous complaints regarding this issues online forum . BMW should take responsibility in resolving this matter maybe it’s in need of a major recall . Furthermore , defects in the emergency call system may result in loss of life / injury what the system was designed features. When I made my purchase on this X5 BMW I was believing its was reliable and trustworthy had me thinking otherwise. 7/14/26 Gotten call today from service advisor they may not be able to resolve issue and mentioned option but didn’t go into details . Afterwards received 2nd text from my service advisor case would be expedited to head engineer of BMW . Wondering what next ??

This is a follow up on a concern that I raised 3 weeks ago. This is a new car that broke down after 157 miles. The car has been disabled since September 4th 2023. As of today, I still do not have it and do not have a clear ETA for the repair. The diagnosis from the dealership is a defective combined charging unit. The part had to be back-ordered from Germany. A week or so after the incident, the service agent at BMW of Portchester (Kurt Hinrichs) told me on the phone that the part is undergoing a design upgrade. Hence the initial 7-10 business days minimum for the part to arrive would have to be revised. I did complain with bmw, including copying the CEO of bmw of north america in one of my complains as I was not receiving any (none) attention from customer service. Customer service did respond after this escalation. They offered me 5000 USD and sent me a check accordingly. They also told me that the part would be received by the dealership by 9/25. The dealership called me then stating that they expect to receive the part towards the end of the week of 9/25. As of today, 9/28 - 12 pm EST, they have not received anything and have been unable to tell me where the part is or when they really expect it. Without the part, the car is not drivable at all. I am sending you this note to report this hoping that there is not something more fundamentally wrong with the 2024 X5 50e, to the point that the manufacturer might be redesigning parts on the fly after having sold the car to at least one customer.

Powertrain / transmission failure

POWER TRAIN

Government / agencyIndexed Oct 9, 2026Source-linkedVerify source — NHTSA complaint #11596211

The bell housing of the car is currently emitting a whistling / rusty tricycle sound at low RPMS (1500-2200 rpms / 30 miles per hour or under). I have had the car in for service. During the last visit, BMW kept it for 30 days and only compared it to the sound of other cars. In being able to duplicate the sound, they stated that the sound is normal. BMW reached its conclusion without conducting any physical inspection of the bell housing and its related components to see why the parts are making the noise. They have no idea as to why the car is generating the noise. My shop foreman wrote the following to my advisor to share with me: "..I narrowed down the noise. Noise is possibly mechanical and coming from bell housing area. Created Tsara case and provided information to BMW and video to see what are the next steps we are going to be taking. I would like to remove the transmission and inspect toque converter and flywheel but need there authorization." But again, because BMW was able to duplicate the noise in other cars, they will not authorize any work to determine the true nature of the sound. In doing so, they cannot, in my opinion, say whether this is a safety issue or not. Imagine traveling at a high speed on the freeway and the power train fails! My foreman remains committed to determining the root cause of the problem. As this is the first year with the hybrid engine, BMW should be required to determine the true nature of the sound and determine if it is a safety concern. A physical inspection of the components is a must!

UNKNOWN OR OTHER,SERVICE BRAKES

Government / agencyIndexed Oct 9, 2026Source-linkedVerify source — NHTSA complaint #11690441

The car suddenly dead in the intersection when driving the car, then can’t start the car, can’t shift the gear, stay in neutral position all the time. A message came out staying “Brake problem “! After around 20 minutes, system messaged us “problem solved, OK to drive “, so we were able to start the engine and start driving as normal. I called Service center let them know the scenario but got no answer. After 4 days same problem reoccurring again, this time car dead during left turn, fortunately no car hit our car (we were having 2 babies in the car). A lot of messages showed up, still mentioned “Brake problems “, and after 15-20 minutes, message us again - “Problem solved, ok to drive “. We have AAA tow the car to BMW service center later since we didn’t feel the message was reliable. The service center identified the problem and replaced the Mechatronics Control Unit and returned the car to us after 7 days. I am concerned about the car’s system message, it’s mentioned “Problem solved, OK to drive “, the message could misleading and have been fatal if we continued driving the vehicle to freeway. After we got vehicle back we were still very cautious about the car. I sent my concern to New Central BMW Alhambra CA about one month ago -to the service manager and requested a written explanation of why this faulty message occurred and how BMW engineer plans to prevent this from happening again. But there was no answer so far. There were a “Brake problem recall” and a “Emission Recall “for this vehicle and we went through the procedure already before these 2 brake problems.

SERVICE BRAKES

Government / agencyIndexed Oct 9, 2026Source-linkedVerify source — NHTSA complaint #11605716

My 2024 BMW X5 has been on recall which is The Integrated Brake (IB) system/ safety recall since February, 2024. The brake system is not functioning properly and sometimes the car brakes automatically by itself which is a concerning issue and may lead to a crash. I have reached out BMW of Silver Spring many times they just don't care and they keep saying we can not do anything at this time and I even drove there couple times to talk to them at the dealership they keep saying same thing we are waiting for the parts. I received a call from one of their service department people called Alex said we have the parts available and we can service your vehicle I was out of town for work and when I came back to Virginia and drove to dealership and asked the same person who called me about the recall repair he said we don't have the parts available and we can not do anything at this time. I told him you called me that you guys have it available and I was out of town and when I returned to Virginia and drove from Stafford, Virginia all the way to BMW of Silver Spring, Maryland for 2 hours with traffic and he kept lying to me that we have to wait and he said he will call me soon in few weeks but it has been months he never called me. and I called him and asked him you never called me how are we going to solve this issue or BMW needs take care of this issue he said I have to call the Corporate I called BMW corporate they keep saying we don't have any answer or we can't tell how long does it take. so the car has been on safety recall for 6 months now and BMW has failing to solve this issue and I have had the worst experience with BMW.

SERVICE BRAKES

17 months

Government / agencyIndexed Oct 9, 2026Source-linkedVerify source — NHTSA complaint #11711745

The failure involves the Integrated Brake System, which is subject to a manufacturer issued safety recall, and related braking components including a wheel speed sensor that is part of the brake and stability control system. The vehicle is currently back in my possession and is available for inspection upon request. My safety and the safety of others were put at risk due to sudden and unpredictable loss of braking capability while driving, including abrupt deceleration and stopping in traffic, creating near collision situations. The issue has been reproduced multiple times and confirmed through repeated service visits, with the first and second recall related repairs performed at BMW of West Houston and a third repair attempt performed at BMW of Houston Midtown, following which the vehicle was returned to me. The vehicle has been inspected by authorized BMW dealerships and BMW North America has been notified, though I have not received guidance from corporate BMW regarding a plan moving forward or instructions on how to proceed should a fourth brake failure occur. Brake related warning lamps and system messages appeared following both the first and second recall repairs, and after the October 30, 2025 recall repair the vehicle experienced a brake system failure within approximately 22 miles of driving despite the presence of warning indicators. Given the repeated failures after recall repairs, the prior warning messages, and the lack of direction from BMW North America, I am concerned about operating the vehicle, particularly for longer distances, due to the unpredictable nature of the brake failures and the unresolved safety risk.

ELECTRICAL SYSTEM,ENGINE

Government / agencyIndexed Oct 9, 2026Source-linkedVerify source — NHTSA complaint #11584824

I am started to lease this car in August 2024. After 2 weeks, the car just halted, unable to move. Luckily this happened in my driveway. It took BMW more than 1 month to repair this. They had to change the combined charging unit with a different part number (upgraded part). At that time the car had roughly 200 miles on the odometer. In February of this year (2024), the car had a drivetrain fault, related to high voltage batteries. That time, it was still drivable but it did spend 2 more weeks at the dealership. Three weeks ago, I had another catastrophic failure with the car halting suddenly. This time, I was not as luck as the first time. It happened away from home. With no power at all, I was able to somehow park the vehicle. It got towed to the dealership again. I don’t have a diagnosis for this case. What they told me is that they thought that this problem with my electric engine was fixed. Last week, after BMW North America instructing the dealership on how to presumably fix the car, the dealership told me that they were told to halt any repairs until further notice. I am left waiting. Even if they think that they may have fix the problem, it seems that bmw does not really know how to address it. There are many such complaints about this specific model on various boards, complaints about high voltage problems, complaints about combined charging units that are defective, complaints about these drivetrain faults and malfunctions. Yet, there are no recalls. I am trying to get this car replaced but I am afraid that it will require a lengthy and expensive legal battle. Please consider looking into it. You will find many customers like me with this model. Having a car halting like this for no apparent reason, without any warning is pretty dangerous. Many thanks.

I am writing to formally document serious and recurring safety concerns with my Certified Pre-Owned 2024 BMW X5e, which I purchased from BMW of Sterling on XXX. On XXX I was merging onto [XXX] during morning rush hour when my vehicle suddenly lost power and shut down in the middle of traffic. The vehicle first displayed a yellow drivetrain warning indicating that I could continue driving at reduced power to the nearest service center. Almost immediately afterward, a red drivetrain warning appeared instructing me to seek service immediately. At that point, the vehicle would not restart and continued displaying the error message. Having a vehicle suddenly become disabled in the middle of a major interstate during rush-hour traffic was both frightening and extremely dangerous. I contacted BMW Assist but was transferred among several representatives without receiving meaningful assistance. VDOT ultimately responded, and the vehicle was towed at my expense to BMW of Sterling. Ultimately, I was informed that BMW of Sterling could not identify the cause of the failure or replicate the problem. I was told that BMW in Germany had been consulted and that the vehicle's electronics had been reset. When I picked up the vehicle, I specifically asked whether it had been tested in electric, hybrid, and sport modes and was told that it had. However, my BMW app indicated that the vehicle had not been charged since before I brought it in for service, which raised concerns for me about the extent of the testing that was performed. On XXX, I drove the vehicle to [XXX], for work. When I returned to the vehicle that afternoon and attempted to start it, I received the same drivetrain warning messages. After approximately 15 minutes, the vehicle eventually started normally, and I was able to drive home without further incident. POWER TRAIN,ELECTRICAL SYSTEM

Government / agencyIndexed Oct 9, 2026Source-linkedVerify source — NHTSA complaint #11576435

I purchased a new BMW x5 50e in September 2023. It currently has 1601 miles. As I was getting onto the freeway onramp on 3/7/24, I felt the SUV losing power and got an error message (actually 2). The first message indicated the "High-voltage system," telling me I could continue driving but should have the system checked. The second message stated a "Drive train malfunction" and indicated roadside assistance was not needed. The error messages provided incorrect guidance as I lost all power to drive the SUV. I could drift the SUV over to the shoulder of the onramp. Fortunately, I had not fully gotten onto the freeway, or I could have been hit when the SUV lost power. The car had no power and would not drive. There was no warning of malfunction prior to the sudden loss of power and the simultaneous appearance of the warning message - one followed by another. I tried restarting the SUV, but it would immediately shift back to Park. It was not drivable, and I had to have it towed by AAA to the dealership. The malfunction has the potential to result in a catastrophic outcome. Upon researching the issue online, I found there are several other BMW owners with the same issue; some have been unable to have the problem fixed. The BMW dealer was not yet able to determine the underlying problems and deny this is a known issue (although it is). They told me they have contacted BMW NA and are waiting to hear back. I was told they did not have a loaner and they had done me a favor by putting my car ahead of others. They will not return my calls (only text messages) and cannot give me information about the problem or timeframe I will go without a car. I read others had similar issues and must have their car repurchased by BMW NA. This seems to be a problem BMW is aware of. I do not know if I can ever feel safe in this SUV - there will always be the concern of the SUV running out of power on the freeway or in isolated areas.

While using the Park Assist feature on my 2024 BMW X5, the vehicle was under active system control during a parking maneuver. The system directed the vehicle in reverse and struck an object. I did not apply the accelerator. The vehicle was operating under Park Assist guidance at the time of impact. The collision resulted in damage to the rear bumper. I have reported this to BMW North America and requested a diagnostic scan to retrieve fault codes from the Park Assist module. What component or system failed or malfunctioned, and is it available for inspection upon request? The Park Assist system (automated parking assistance) malfunctioned during an active parking maneuver. While the system was in control of the vehicle, it directed the car in reverse and struck an object. The vehicle is available for inspection upon request. How was your safety or the safety of others put at risk? The vehicle moved autonomously and struck an object without driver input, resulting in a collision. A pedestrian, cyclist, or other vehicle in the path could have been seriously injured. The incident demonstrates the system cannot be trusted to safely detect and avoid obstacles while in control of the vehicle. Has the problem been reproduced or confirmed by a dealer or independent service center? Not yet. The vehicle is being brought to the selling dealer for a diagnostic scan to retrieve fault codes from the Park Assist module. This report is being filed prior to that inspection. Has the vehicle or component been inspected by the manufacturer, police, insurance representatives or others? Not yet. BMW North America has been notified. Dealer inspection is pending. Were there any warning lamps, messages or other symptoms of the problem prior to the failure, and when did they first appear? No warning lamps or messages appeared prior to the incident. The system gave no indication of malfunction before directing the vehicle into the object.

POWER TRAIN,SERVICE BRAKES

Government / agencyIndexed Oct 9, 2026Source-linkedVerify source — NHTSA complaint #11690997

2024 BMW X5 with 22k miles, leasing the vehicle. Had the vehicle in the dealer, Herb Chambers BMW of Boston a few months ago to fix a brake recall and change the oil. Dealer said they fixed both, and also said they needed the vehicle all day to fix the brakes, so they got me an Uber and then dropped off the vehicle when it was completed. Fast forward to today, October 2, 2025. Drive train warning came up when driving the vehicle, told to find a safe place to stop, within 10 seconds the vehicle lost most of engine power. Was able to stop in a safe location, contacted roadside assistance, numerous warnings came up on screen. Roadside assistance said to start and stop the vehicle and this cleared the message, said that vehicle was safe to drive, it was probably just a sensor issue that put the vehicle into some type of safe mode (what a horrible thing to do, an enormously unsafe as the operator should determine this). Two days later, another drive train warning and the vehicle on it's own moved the transmission into neutral while driving at 30mph. This issue with going into neutral on it's own, I found out through speaking with my wife, that this happened a couple of week prior as well. I called road side assistance and had the vehicle towed, called the dealer to get a loaner as this vehicle is not safe to drive in it's current condition. After this issue, I looked my vehicle up by VIN and saw that the brake recall wasn't fixed yet to my surprise. When I spoke to the dealer today as the vehicle was being towed there with this drive train issue, I said were my brakes for this recall fixed, they said the software issue was fixed, but not the mechanical issue. I said please fix this brake recall while in there looking at this drive train issue. Vehicle is clearly not safe to drive in this condition, and you can use your imagination if this happened while driving at highway speeds or various other scenarios, not good at all.

SERVICE BRAKES,FORWARD COLLISION AVOIDANCE

In February,2024[12th]. BMW FILED A RECALL NOTICE ABOUT A DEFECTIVE PART IN THE BRAKING SYSTEMS OF 2023,2024 models 5series, 7 series, x1,x5,x6,x7 and Xm. My vehicle was made in mid March and delivered early April. Supposedly according to my source , BMW received replacement parts from the vendor and production continued. I’m not sure if it ever stopped. The problem is BMW NEVER TESTED THESE NEW PARTS TO SEE IF THEY FIXED THE PROBLEM. THIS IS CLEARLY NEGLIGENCE ON THEIR PART. THE DEGREE THE LAWYERS CAN DETERMINE. NOW AROUND August12, BMW ISSUED A STOP SALE ON ALL THESE CARS INCLUDING SOME 2025 MODELS. ONLY BECAUSE I READ A USER BLOG ON LINE ABOUT THIS AND CHECKED MY VIN WAS I AWARE IT AFFECTED MY CAR. NO NOTICE FROM BMW. This was not a don’t drive notice. The effect on owners is they can’t trade or sell their cars. There does not seem to be a requirement that BMW file a STOP SALE order with NHTSA. I DON’T BELIEVE THEY FILED A SUBSEQUENT NOTICE TO THE FEBRUARY FILING. Every day there are recall notices. Most are narrow in scope but this will involve umpteen thousands of cars. There is no end date because they don’t know when a new part will be available. Once available it could be many months before owners are able to have the problem part replaced. It takes 2+ hours a car. The dealers are already overwhelmed because of limited space and mechanics. If these companies don’t get fined for this type of behavior, it will not stop. I am talking millions in fines. The FAA does it. More people drive than fly yet it seems the Federal Transportation Department does not have or doesn’t want to exercise this option. Just look at what has been going on for over 15 years with Takata airbags which could be fatal if opened. Just today 577,000 cars from Ford and Mazda were issued a DO NOT DRIVE notice on the news. Granted they were for older models but people who need transportation will still drive. Why hasn’t the government over the past 15+ years stopped the buying of them.

I am filing this complaint regarding serious safety issues with my 2024 BMW X5 xDrive50e, which currently has approximately 12,000 miles. 1. Drivetrain Malfunctions and Assembly Error: The vehicle experienced three instances of drivetrain malfunctions within an eight-day period, causing it to go into limp mode unexpectedly while driving. The issue was identified as a misrouted wiring harness, which has since been repaired. I was informed by the BMW technician that a service bulletin addressing this issue was released 6 months prior to the production of my vehicle. Despite BMW’s knowledge of this recurring problem, the vehicle was assembled incorrectly, creating a significant safety hazard. This failure to address known issues during production resulted in potential disaster, compromising my safety and that of others on the road. 2. Unresolved Safety Recall – Regenerative ABS Braking System: The vehicle is subject to an ongoing recall for the regenerative ABS braking system, with no available remedy at this time. The lack of resolution for this critical safety component raises further safety concerns. 3. Connectivity Issues: The eSIM car connect hotspot has been inoperable, and BMW has acknowledged the problem, suggesting that I wait for potential updates. This impacts navigation and other safety-related features. Safety Concerns: These combined issues indicate that I was sold a vehicle with known safety defects that were not properly addressed at the manufacturing stage. As a consumer, I require a reliable and safe vehicle, which the 2024 BMW X5 xDrive50e has failed to provide. The fact that BMW was aware of this recurring issue through a bulletin prior to my vehicle’s production adds to the urgency of resolving these problems. Resolution Attempts: I have worked with the local BMW dealership to repair the wiring harness, but the unresolved ABS recall and connectivity issues persist. BMW has not provided a clear timeline for resolving the safety recall.

SERVICE BRAKES

Government / agencyIndexed Oct 9, 2026Source-linkedVerify source — NHTSA complaint #11758732

I am requesting NHTSA assistance regarding a serious and recurring braking safety concern involving our BMW X5. We initially reported braking problems to BMW and brought the vehicle to the dealership for evaluation. We were advised that the vehicle was operating normally. Subsequently, a brake related recall was issued, and the vehicle underwent recall related service. Despite this, braking concerns continued. We again reported the problem and were advised after evaluation that the vehicle was operating properly. There were subsequent incidents involving abnormal braking behavior. During 1 incident, my wife was slowly parking the vehicle when it did not stop as expected despite repeatedly applying the brake pedal. The vehicle continued moving and collided with a wall before eventually stopping. We have also experienced abnormal brake vibration and other concerning braking behavior. Because of these repeated safety concerns, the vehicle is currently the subject of pending lemon law litigation involving BMW North America. Most recently, we returned the vehicle to the BMW dealership because of the braking and safety concerns. The vehicle remained there for approximately 4 months. We have not received a clear explanation of what diagnostic testing, inspection, repair, or corrective work was performed during this extended period. We were then informed that the vehicle was ready for pickup. When we went to retrieve it, it was covered with substantial dust and had very low tire pressure. We were unable to take it home. Our primary concern is safety. We do not know whether the reported braking malfunction was identified or corrected, what was done during approximately 4 months at the dealership, or the technical basis for releasing the vehicle for operation. We regularly transport our young children in this vehicle and are extremely concerned about driving it without knowing whether the braking problem has been properly identified and addressed. We respectfully request

2024 July summer time, the compressor started same issue as the temperature increased. All of a sudden, the car was started showing major “drivetrain error” and “high voltage battery error”. I have taken the car again back to the same dealership and this time the car was starting to show major system failures. I have kept BMW in the email loop and at the first instance itself I have called out that cooling issues can cause battery issues, and it happened exactly like that after 7 months. Car was with the dealership from 07/22/2024 mileage: 7896 to 07/24/2024. Dealership said this was just a software issue even though there were errors related to high voltage, after 3 days, dealership simply updated the software and cleared all the issue and related the car stating that everything fixed. I have attached the service appointment letter for this issue. It looks like they wanted me to cover the 12 months after delivery so that they can be safe with lemon law, and it proved true with next incident. After the 3 months, a terrific incident happened on [XXX] Mileage:10,561. I was taking my [XXX] daughter for a doctor’s appointment along with my [XXX} daughter and my wife. It was a short trip less than 5 miles from my home. While in the state highway, while driving ,all of a sudden the car lost all of its power car had 12 miles of electric range and 227 miles of gas range, I have photo proof from this time either from electric motor and from the gasoline engine and stalled and stopped in the middle of the road with the EXACT SAME problem on “drive train error” mentioned above serviced on 07/22/2024. There was a truck behind us and the driver had to sudden break not to rear end us. The situation was terrific, and I cannot explain it through letters here. My wife and my [XXX] panicked, and they had to went through the trauma. I was thrown into a situation by BMW and the since I purchased a costly brand-new car for my family and trusting BMW,still in dealer INFORMATION REDACTED
